Die UN-Leitprinzipien (UNGPs) und die menschenrechtliche Sorgfaltspflicht (HRDD)
The UN Guiding Principles (UNGPs) and Human Rights Due Diligence (HRDD)
Summary
In this episode of Linguistic AlgoRhythms, hosts Andrea and Stefanie explore how everyday consumer products are made and examine the corporate accountability behind them. They unpack the "Three Pillars" of the UN Guiding Principles on Business and Human Rights and delve into the historical milestonesâsuch as the 2013 Rana Plaza tragedyâthat spurred mandatory supply chain due diligence. Along the way, the discussion highlights the human cost of fast consumption, the balance between corporate ethics and economic realities, and the actionable power consumers hold through mindful choices and transparency.
Hello and welcome to a new episode of Linguistic AlgoRhythms!
I'm Andrea, and today I have the wonderful Stefanie with me in the studio once again.
Hi Stefanie, wie gehtâs dir heute?
Hi Stefanie, how are you doing today?
Hallo Andrea!
Hi Andrea!
Mir gehtâs super, danke.
I'm doing great, thanks.
I'm really excited that we're talking about such an important topic today.
Ja, absolut.
Yeah, absolutely.
But to be honest, Stefanie, the idea for this episode actually came to me yesterday during a situation where I felt pretty uncomfortable.
Oh, was ist denn passiert?
Oh, what happened?
ErzÀhl mal!
Tell me!
Well, I was in town and wanted to buy a new T-shirt.
I found one that looked really great, and it only cost four euros fifty.
Zuerst dachte ich: âSuper SchnĂ€ppchen!â
At first I thought, "What a bargain!"
But then I was standing at the register and suddenly wondered: "Wait a minute, how is that even possible?"
Das kenne ich.
I know that feeling.
You do the quick math in your head: materials, shipping, store retail work... there's practically nothing left for the person who sewed it, right?
Genau das ist der Punkt!
That's exactly it!
I felt awful and put the shirt back.
In our globalized world, we often have no clue where our things come from.
We buy things without thinking about the consequences.
Das ist eben die Schattenseite der Globalisierung.
That's the dark side of globalization.
We're all connected, but we don't see the problems on the other side of the world.
That's why it's so important that we talk today about the rules designed to change that.
You mean those terms I read in the newspaper the other day?
âUN-Leitprinzipienâ und âmenschenrechtliche Sorgfaltspflichtâ?
"UN Guiding Principles" and "human rights due diligence"?
Phew, Stefanie, honestly that sounds like a lot of dry theory and complicated jargon.
Can you explain it to us without putting us right to sleep?
Ha, ich verspreche es!
Ha, I promise!
It sounds dry, but it really comes down to a very simple question: How do we make sure the people making our phones and clothes are treated fairly and kept safe?
Okay, ich bin gespannt.
Okay, I'm intrigued.
Also, was verbirgt sich hinter diesem langen Wort âUN-Leitprinzipienâ?
So, what's behind this mouthful "UN Guiding Principles"?
It's essentially a kind of global etiquette guide or code of conduct for businesses.
It's about ensuring human rights are respected everywhere.
Das ist unser erstes wichtiges Wort heute.
That's our first key concept today.
Human rights are the fundamental rights that belong to every person on Earthâno matter what country they come from.
That includes things like not being forced to work, and having a safe working environment.
And these Guiding Principles are built around "Three Pillars", right?
Das habe ich mal gehört.
I think I've heard that before.
Ganz genau!
Spot on!
Imagine a house standing on three sturdy pillars.
Die erste SĂ€ule sagt: Der Staat muss die Menschen schĂŒtzen.
The first pillar states: The state has a duty to protect people.
So if a factory collapses in a country, the government is responsible for creating and enforcing safety regulations.
Okay, das leuchtet ein.
Okay, that makes sense.
Und die zweite SĂ€ule?
And the second pillar?
That must apply directly to companies, right?
Richtig geraten!
Right you are!
The second pillar states that businesses have a corporate responsibility.
Responsibility here means a company can't just throw up its hands and say, "We had no idea children were working in that Asian factory."
They have an active duty to make sure they aren't violating people's rights.
But Stefanie, isn't that a bit naive?
In the past, companies didn't care at all about what happened in distant countries, as long as the profits rolled in.
Da hast du absolut recht.
You're completely right.
Twenty or thirty years ago, things looked very different.
Da gab es kaum Regeln.
There were hardly any rules.
Aber heute hat sich die Sichtweise geÀndert.
But the perspective has shifted.
The UN Guiding Principles made it clear that profit isn't everything.
And the third pillar is "Access to Remedy".
That means if something terrible does happen, victims must have a way to speak up, file complaints, and receive fair redress.
Wow, that sounds like a real paradigm shift in the business world.
But what does that look like in practice?
We're talking about abstract pillars, but what does that mean for my T-shirt or my smartphone?
Let's take that T-shirt example and look closely at the supply chain.
The term supply chain describes the entire journey of a productâfrom raw material all the way to the finished item on the store rack.
Okay, fangen wir mal ganz vorne an.
Okay, let's start at the very beginning.
Da ist das Baumwollfeld, oder?
That would be the cotton field, right?
Genau.
Exactly.
Die Baumwolle muss gepflanzt und geerntet werden.
The cotton has to be planted and harvested.
Often, hazardous pesticides are used that ruin the farmers' health.
Das ist schon das erste Problem.
That's already the first issue.
After that, the cotton goes to a spinning mill where it's turned into yarn.
And then the fabric is woven and dyed.
I once heard that dyeing chemicals are often dumped straight into local rivers.
Das zerstört ja die ganze Natur dort!
That completely destroys the local ecosystem!
Eben!
Precisely!
And eventually the fabric arrives at a garment factory.
Da arbeiten oft hunderte Menschen in riesigen Hallen.
Hundreds of people often work there in massive halls.
Und hier kommen die Arbeitsbedingungen ins Spiel.
And that's where working conditions come into play.
By working conditions, we mean everything that impacts the job: What are the wages?
Gibt es Brandschutz?
Is there proper fire safety?
MĂŒssen die Leute 14 Stunden am Tag arbeiten, ohne Pause?
Are people forced to work 14-hour days with no breaks?
Ach echt?
Really?
Das ist ja schrecklich.
That's terrible.
Thinking about someone working in intense heat and noise all day just so I can have a dirt-cheap shirt... that's really tough to stomach.
Genau das ist der âmenschliche Preisâ.
That is precisely the "human cost".
And supply chains are often so long and intricate that a European or American company might not even know who manufactured the buttons for that shirt.
But the new rules say: No, you have to know!
Ihr dĂŒrft die Augen nicht mehr verschlieĂen.
You can't turn a blind eye anymore.
Warte mal, Stefanie.
Wait, Stefanie.
Does that mean companies have to play detective and inspect every single tiny workshop on the other side of the planet?
So Àhnlich!
Something like that!
Sie mĂŒssen prĂŒfen, wo die Risiken liegen.
They have to assess where the risks lie.
But tell me, Andrea, any idea why these rules are being enforced so strictly now?
Was there a specific turning point in history?
Well, I vaguely remember news about a massive factory disaster a few years ago.
War das nicht in Bangladesch?
Wasn't that in Bangladesh?
Ganz genau, Rana Plaza im Jahr 2013.
Exactly, Rana Plaza in 2013.
A huge commercial building collapsed where clothes for many famous Western brands were being sewn.
Ăber tausend Menschen sind gestorben.
Over a thousand people died.
It was a massive shock to the international community.
That was the moment when everyone realized voluntary corporate promises just weren't cutting it, right?
Exakt.
Exactly.
People realized there was a gaping "governance gap".
That means corporations are often far more powerful than the local laws in developing countries.
So John Ruggie, appointed by the UN, spent years developing a standard that applies across the board.
He wanted to build a bridge between ethics and business.
So he was basically the architect of these "Three Pillars"?
Ja, genau.
Yes, exactly.
He understood that you can't just force companies through bans alone; you have to get them to recognize their own role.
The point was that companies have to demonstrate: "We did everything reasonably possible to prevent harm."
Das klingt nach einer tollen Entwicklung.
That sounds like great progress.
But I imagine not everyone is thrilled about it.
There must be some pushback against all these regulations, right?
Now let me play devil's advocate for a second.
Stefanie, if I run a small business in Germany with only twenty employees, how on earth am I supposed to monitor a plantation in Brazil?
Das ist doch ein bĂŒrokratisches Monster!
That sounds like a bureaucratic nightmare!
Das ist tatsĂ€chlich der gröĂte Kritikpunkt.
That really is the primary criticism.
Viele Firmen schimpfen ĂŒber die sogenannte Sorgfaltspflicht.
Many companies complain about due diligence requirements.
Das ist unser nÀchstes Wort.
That's our next key term.
Sorgfaltspflicht bedeutet, dass man sehr grĂŒndlich und vorsichtig prĂŒfen muss, ob alles fair zugeht.
Due diligence means conducting thorough and careful checks to ensure ethical and fair practices throughout.
Critics argue that the implementation of these rules is far too costly.
Umsetzung heiĂt hier, die Regeln wirklich in die tĂ€gliche Arbeit einzubauen.
Implementation means actually integrating these standards into daily business operations.
And doesn't that risk companies just throwing in the towel and saying, "This country is too risky, we won't buy anything from there anymore"?
Ich habe gehört, man nennt das âDe-riskingâ.
I think they call that "de-risking".
If companies simply pull out, the local workers lose their jobs!
Dann ist ihnen ja auch nicht geholfen.
That doesn't help them either.
Das ist ein sehr wichtiger Punkt, Andrea.
That's a crucial point, Andrea.
If businesses simply cut and run rather than improving local conditions, they actually harm workers even more.
That's why it's vital that companies partner with their suppliers and factories rather than terminating contracts overnight.
Let's look at the flip side.
What are the benefits for companies?
Aside from sleeping with a clean conscience?
Da gibt es einige!
There are quite a few!
Ein groĂes Thema ist die Transparenz.
A major factor is transparency.
Transparency means a company openly discloses how it operates.
Heute wollen die Kunden wissen, was sie kaufen.
Today's consumers want to know what they're buying.
When a company is honest and demonstrates that it cares about people, it builds genuine consumer trust.
In today's market, that trust is worth far more than just offering the lowest price.
True, I definitely prefer buying from brands I can trust.
And in the long run, fair wages and safe working conditions contribute to broader economic stability in those countries, don't they?
Absolut.
Absolutely.
You see fewer strikes, higher production quality, and a fairer global economy overall.
In many places, like Germany with its Supply Chain Due Diligence Act, these standards are now legal obligations.
Man kann also nicht mehr wĂ€hlen, ob man nett sein will â man muss es sein.
Being socially responsible is no longer optionalâit's mandated by law.
That's all well and good, Stefanie, but what can ordinary consumers do?
When I'm in a supermarket or clothing store, I often feel overwhelmed by all the conflicting labels and information.
I completely empathize; I feel the same way often. But I try to focus more and more on sustainability. We hear that word constantly, but here it simply means: acting in a way that preserves the world as a viable, healthy place for future generationsâboth for nature and for people. For instance, I love shopping second-hand or looking for certified labels like "Fairtrade".
I recently discovered a brand that makes backpacks out of ocean plastic waste.
And on their website, you can see exactly who made each backpack and where.
They even post photos and profiles of their craftspeople!
Das ist ein super Beispiel fĂŒr Transparenz!
That's an outstanding example of transparency!
And that's what consumer power is all about.
When we support brands like that, the corporate giants eventually have to follow suit.
Every time we spend money, we're voting for the kind of economy we want to see.
Das stimmt.
So true.
It's not just the responsibility of politicians or the UN.
All of us are part of the supply chain because we're the end users.
Before we wrap up, let's do a quick recap of the core concepts we talked about today.
Willst du mal anfangen, Andrea?
Andrea, do you want to kick us off?
Gerne!
Gladly!
First, human rights are the bedrockâeveryone is entitled to dignity and safety.
And corporations have a responsibility to uphold them, meaning they must take accountability for their actions.
Genau.
Exactly.
And what do we call the whole journey a product takes?
Das ist die Lieferkette.
That's the supply chain.
Vom Rohstoff bis zum Laden.
From the raw materials to the retail shelf.
And throughout that chain, we have to look closely at working conditionsâthe actual reality of people's daily work.
Perfekt.
Perfect.
And then we had that crucial concept: due diligence.
That requires companies to investigate thoroughly whether their operations are causing harm anywhere.
Implementation is the concrete process of putting those policies into practice.
And finally, we covered transparencyâbeing open and honest about productionâand of course sustainability, ensuring we don't compromise the planet for future generations.
Well done, Andrea! You've got these concepts down cold. You're practically an expert in business ethics now.
Wow, Stefanie.
Thanks, Stefanie!
Listening to all this really drives home that while the topic is complex, at its core it's about something wonderfully simple: showing respect for our fellow human beings.
Ganz genau.
Precisely.
No matter how far away someone lives, their labor and their life have inherent dignity.
That's worth keeping in mind the next time we go shopping.
Thank you so much for joining us today and breaking down such a complex topic with such clarity!
I had a wonderful time talking with you.
Sehr gerne, Andrea!
It was my absolute pleasure, Andrea!
It's such a vital conversation to have.
And to our listeners: next time you slip on a pair of shoes or put on a sweater, take a look at the label.
Think about the incredible journey that item took to reach you.
Wir hören uns beim nÀchsten Mal!
We'll catch you next time!
TschĂŒss und bis bald!
Goodbye and take care!
TschĂŒss!
Bye!
